Terms of Service

These Terms of Service (the “Terms”) govern your use of the Wispframeapplication for macOS (the “Software”), the website at wispframe.app(the “Website”), and any related services (together, the “Services”). By downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not use the Services.

1. Provider (Szolgáltató)

The Services are provided by:

(the “Provider”, “we”, “us”).

2. License grant (EULA)

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on Apple Silicon Macs that you own or control, for your own personal or internal business purposes.

2.1 Free tier

The free tier includes the full feature set with unlimited recording length; videos produced by the processing tools carry a small Wispframewatermark. The free tier is not time-limited and requires no account.

Commercial use is expressly permitted on the free tier. You may use free-tier output — watermark included — for any lawful purpose, personal or commercial. The watermark itself is the only boundary between the tiers: watermark-free exports require a Pro license, and the watermark may not be removed, cropped out, covered, or otherwise circumvented by technical means (see 2.3).

2.2 Pro (annual or lifetime)

A Pro license — annual subscription or one-time lifetime purchase — removes the watermark from processed exports and includes the features described on the Pricing page. The entitlement follows your Apple Account, so Restore Purchases unlocks Pro on every Mac you sign in on — there are no licence keys and no activation limit of ours.

2.3 Restrictions

You may not:

  • copy (except for a reasonable backup), distribute, rent, lease, sublicense, or resell the Software;
  • reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is prohibited by applicable law;
  • circumvent, remove, or tamper with license enforcement or the free-tier export watermark — including cropping, masking, or re-encoding the output to hide it; watermark-free exports are exclusively a Pro feature;
  • use the Software to record content unlawfully. You are solely responsible for complying with applicable laws when recording your screen, system audio, microphone, or camera — including obtaining any consent required from people who appear in or are heard on your recordings.

2.4 Ownership

The Software is licensed, not sold. We and our licensors retain all rights, title, and interest in the Software. Content you record or produce with the Software — on the free tier and on Pro alike — belongs entirely to you; we claim no rights over your recordings or exports and — by design — never receive them.

3. Subscriptions, prices, and billing

  • Prices: Wispframe Pro costs $29.99 per year, or $79.99once for a lifetime license. Prices are shown in your App Store storefront's local currency, and tax is handled by Apple.
  • Automatic renewal: subscriptions renew automatically at the end of each billing period at the then-current rate applicable to your plan, unless cancelled before the renewal date.
  • Cancellation: you may cancel at any time, effective at the end of the current billing period. After cancellation, the Software reverts to the free tier — your recordings are unaffected.
  • Payment processing:Pro is sold as an in-app subscription through Apple's App Store using StoreKit. For these in-app purchases Apple acts as merchant of record and handles billing, renewals, and — for App Store purchases — refunds under Apple's Media Services Terms. Apple's terms apply to the payment transaction.
  • Price changes take effect for new billing periods only and will be announced at least 30 days in advance by email or in-app notice.

4. Right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU or EEA, you have the right to withdraw from a purchase within 14 days without giving any reason, as described in our Refund Policy. For digital content and digital services, the statutory exceptions of Directive (EU) 2011/83 apply as set out there. Because Apple is the seller of record for App Store purchases, the refund itself is issued by Apple — we do not receive or hold your payment, and so cannot return it ourselves. We will support any valid request with Apple until it is resolved.

5. Updates and availability

We may provide updates that add, change, or remove functionality. Nothing in these Terms obliges us to provide updates or maintain any specific feature. The Software works fully offline once the optional ML models are cached; it never connects to a server operated by us.

6. Warranty disclaimer

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Software will be uninterrupted or error-free, or that every recording will be preserved in every circumstance. This does not affect statutory warranties that cannot be excluded under the law of your country of residence — for EU consumers, the statutory conformity rights under Directive (EU) 2019/770 remain unaffected.

7. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including lost profits, lost data, or lost recordings — arising out of or relating to your use of the Services. Our total aggregate liability shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim, or USD 50 if you have paid nothing. Nothing in these Terms excludes liability for intent, gross negligence, death or personal injury, or any liability that cannot be excluded by law.

8. Termination

You may stop using the Software at any time. We may terminate this license if you materially breach these Terms and, where the breach is curable, fail to cure it within 14 days of notice. Sections 2.4, 6, 7, and 9 survive termination.

9. Governing law and disputes

These Terms are governed by Hungarian law — in particular the Hungarian Civil Code (Act V of 2013), Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses, and Act CVIII of 2001 on certain aspects of electronic commerce services (Eker. tv.) — as well as applicable EU consumer-protection rules, including Directive 2011/83/EU on consumer rights, excluding conflict-of-law rules. If you are a consumer, you also enjoy the protection of the mandatory consumer-law provisions of your country of residence, and you may bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the Website and, for subscribers, by email at least 30 days before they take effect. If you continue using the Services after the effective date, the updated Terms apply. If you do not agree to a material change, you may cancel your subscription through Apple; we will support a refund request with Apple for the unused period. Because Apple is the merchant of record, the refund decision and the payment are Apple's (see the Refund Policy).
